Who we are

HabitCure Inc. ("HabitCure", "we", "us") is a Delaware corporation headquartered in San Jose, California. We build and operate the HabitCure iOS application and this website.

Your account

Beta program

HabitCure is currently in closed TestFlight beta. Beta software may contain bugs, may lose data, and may change without notice. You use the beta at your own risk. Do not rely on beta features for anything safety-critical.

Founding Member pricing

If you join the beta before public launch, we lock your rate at $5.99/month for life on the Consumer tier. This rate applies as long as you maintain an active subscription. If you cancel and re-subscribe later, the current retail rate applies.

Not medical advice

HabitCure is a wellness product, not a medical device. Nothing in the app diagnoses, treats, cures, or prevents any disease. Do not use HabitCure in place of professional medical care. If you are experiencing a medical emergency, call 911 or your local emergency number.

Your content and data

You own your health data. We hold a limited license to process it for the sole purpose of providing the HabitCure service. We do not sell, rent, or share your data with advertisers, insurers, or employers. Full detail in our privacy policy and health data policy.

Prohibited use

Intellectual property

HabitCure, the HabitCure logo, and the underlying detection methods (Cardiac Drift, paired-window athletic, pathway conflict, cranial sensor array, PROV006 sensor fusion) are the property of HabitCure Inc. Five USPTO provisional patent applications are pending. You get a personal, non-transferable license to use the app — nothing more.

Termination

You can stop using HabitCure at any time. We can terminate an account if you violate these terms or if operating your account would put other users at risk. If we terminate you, we'll email you first except in cases of urgent safety.

Warranty disclaimer

The service is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, HabitCure disclaims all warranties, express or implied.

Limitation of liability

HabitCure's total liability to you for any claim is limited to the amount you paid us in the twelve months before the claim, or one hundred US dollars, whichever is greater.

Governing law

These terms are governed by the laws of the State of California. Any dispute goes to the state or federal courts sitting in Santa Clara County, California.

Changes

We may update these terms. Material changes get an email notice at least 30 days before they take effect. Continuing to use the service after the effective date means you accept the new terms.
